Unfair Advantage and Unfair Detriment – What are they?
A true but perhaps unhelpful answer is “It depends on what the rights are and what has been done”. The ways in which businesses and parties find to take advantage of each other’s rights is almost infinite, and so there is no complete list. More usefully, there are some common indicators which the policy sets out in paragraph 3 for why a registration might be abusive and then paragraph 4 sets out some reasons why it might not be abusive.
