Generally, COBRA applies to all employers that offer employee group health plan coverage and that employ 20 or more employees on 50% of the business days in the preceding calendar year. Federal, state and local government and church plans are not required to comply with the COBRA Regulation. However, there are similar provisions contained in the Public Health Service Act (PHSA) that may apply.
