In most planning situations, an easement is a legal agreement in which the easement holder is given some type of limited use of another property owner’s land. A good example would be an access easement. An access easement would allow the owner of property that has no road access to access their property across a specified portion of another land owner’s property. The area within the easement belongs to the land owner, but is legally accessible to the easement holder for purposes of automobile access. You cannot build anything on an easement that would infringe on the easement holder’s limited use of the portion of the property.
