What crimes constitute the death penalty?

I think you mean “what crimes are punishable by the death penalty?” The only such crime upon which all states have agreed, at various times, is murder, in various forms. Some states have laws allowing the death penalty in other types of cases, as well (see links). World War III, in his typically reasoned way, seems to think that there are no crimes that are punishable by death. He is, as usual, wrong, as the links I have provided clearly demonstrate. If he is so enamored of the death penalty he should move to Texas, where I live. In 2007 alone, Texas executed 26 people, almost double all the other states combined.
