What do you think of section 187 of the California Penal code which making killing the fetus murder?
Sorry, but killing a fetus isn’t murder in the CA Penal Code. You forget to include the rest of the statute: 187. (a) Murder is the unlawful killing of a human being, or a fetus, with malice aforethought. It’s that “with malice aforethought” which make all the difference. And there’s a long section defining “malice”. You’re right. I was using what I knew about previously adjudicated cases. I’m a legal researcher so of course I had to look it up;-) It’s still that pesky “with malice aforethought” and a couple of other things like “without the consent of the woman carrying the fetus”.
