What does HB 1711 mean, when it calls for a hearing for disciplinary action?
The Commissioner of Safety would request a hearing to be conducted pursuant to RSA 541-A and SafC 200. The use of the title commissioner is because he/she is the responsible party for the Department of Safety which we fall under. The reference to RSA 541-A and SafC 200 is the rules for conduct of a disciplinary hearing. The hearing is conducted by a hearings officer who is an attorney that handles the action in the same manner as if you were in a courtroom in front of a judge if this was a criminal matter. The commissioner is not the one that makes the determination of the disciplinary action. He/She would only be the one that forwards the complaint to the hearings officer for the administrative hearing pursuant to established law and rules. There is also an appeal process specified in RSA 541 for any appeals to decisions of the commissioner following a hearing.
