That depends on the contract and teh actual status of the employee according to your policies. You would have to check your benefits Contract – Ind. contractors should have no restrictions on when how or where they work or they may not be ind. contractors. So it would have to be established in the contract that they have the holidays paid however, you cannot mandate they work these days either.
