The Special Magistrate will hear the cases presented by the Code Officer and the property owner, if present. Based upon the testimony provided at the hearing, the Special Magistrate will determine if a violation exists and direct that the violation be corrected within a specified period of time. A fine amount will be established and a lien may eventually be recorded against the property if the violation is not corrected. An Order will be issued whether or not the property owner is present at the hearing. Q. Will I have to pay a fine? In most cases the costs that the Code Compliance Division incurs in the prosecution of a case to the Special Magistrate hearing will be assessed against the property owner.
