If the homeowner has not corrected the violation or acknowledged the violation, then a second notice is mailed. If all these letters are ignored, then the homeowner is sent a certified notice to appear at a hearing before the Board of Directors. At that hearing, the homeowner may explain the situation and request further time to make the repairs. The request may be granted or the homeowner may be assessed fines or penalties for non-compliance. If the homeowner does not appear at the hearing, fines or penalties may be assessed of $10 per day, up to 90 days, for continued violation of the ACC rules.
