What if an applicants criminal history reveals open or pending criminal charges?
If the pending charge is for a felony offense, OMH is required to hold the application in abeyance (put the application on hold) and will not make a determination on the suitability for employment until a disposition is rendered and a court certified copy is provided to BCHI.If the pending charge is for a misdemeanor offense, OMH may, in its discretion, hold the application in abeyance until the charges are resolved.
