An employee may raise a grievance under the statutory procedure after his or her employer has begun disciplinary procedures against them on the grounds that either the action amounts to unlawful discrimination or has not been taken on grounds of their capability of conduct (for instance, if it is the result of a personality clash with his or her line manager). If the grievance is raised at any stage before the appeal stage (Stage 3), the grievance will be heard as part of the disciplinary procedure and the employee will be treated as having complied with the statutory grievance procedure and will not be barred from bringing a claim before an employment tribunal. If the employee raises the grievance during or after the step 3 appeal, the three-step grievance procedure must be applied in full.
