One or both parents must file a petition to rescind the AOP. The petition must be filed in court within the first 60 days after the AOP was recorded at VSU. Also, one or both parents may challenge the AOP — from the 61st day to four years after the AOP was recorded at VSU.The petition again must be filed in court and the parent filing must prove fraud, duress or material mistake of fact. An AOP cannot be challenged after four years, except in the case of a minor. Minors have an additional four years from the time they emancipate or turn 18 to challenge an AOP.
