WHAT IF THE MAN ALLEGED TO BE THE FATHER IS SERVED, BUT DOESNT SHOW UP FOR HEARING?
Various things can happen if the potential father has been served, but does not show up for the hearing. 1. If there is only one possible father, the Family Court Commissioner may find him to be the father (called a default judgment of paternity). The decision whether to enter a default judgment is made on a case-by-case basis based upon the factual circumstances. 2. If there is more than one possible father, the court would order genetic testing. 3. The case may be adjourned to a later date. Notice will be given to both parties to appear at this new time.
