What is a Manifestation Determination Review?
Any discipline-related change in a Special Education student’s ARD approved placement (IEP) for longer than 10 days in a school year, consecutive or not, requires that the ARD Committee meet to conduct a Manifestation Determination. Such change in placements may include discipline-related removals due to in school suspensions, emergency removals, suspensions, and alternative education placements. The Manifestation Determination ARD meeting reviews the relationship between the child’s disability and the behavior subject to the disciplinary action. If the ARD Committee determines that the behavior for which removal is being recommended is not a manifestation of the disability, that student may be consequated in a manner similar to any other nondisabled student who has committed a similar offense.
