What is a manifestation determination?
A. A “manifestation determination” is a decision about the relationship of the behavior subject to disciplinary action and the student’s disability and IEP. An ARD committee first discusses the specific behaviors that resulted in disciplinary action. Then the committee reviews relevant information about the student, and the student’s IEP and placement. Based on the consideration of all relevant information, the ARD committee may determine that the behavior is not a manifestation of the student’s disability only when the following conditions are met: *in relationship to the behavior subject to disciplinary action, the student’s IEP and placement were appropriate and the special education services, supplementary aides and services, and behavior intervention strategies were provided consistent with the student’s IEP and placement; *If these are appropriate and current, then the ARD committee must determine if: (1) the student’s disability impaired the ability of the student to understand
