These are adoptions in which a spouse of a biological parent seeks to become the legal parent of a child. The adoption terminates the rights of the other biological parent (not the spouse of the prospective adoptive parent). Frequently, the child's name is changed as part of the adoption. A court generally will not grant a stepparent adoption when the child's legal mother or legal father objects and is participating in the child's life in a meaningful way.  more

A stepparent adoption is when a child is adopted by his or her stepmother or stepfather. The natural parent and the stepparent both have to sign the petition to adopt. The rights of the other natural parent have to be terminated - by consenting to the adoption or by involuntarily termination of parental rights. Usually, the Court will not require a homestudy in a stepparent adoption, although the stepparent must still have a criminal background check and abuse/neglect registry check.  more

A stepparent adoption occurs when a stepparent petitions the court for adoption of his/her spouse's child (current spouse of stepparent) from a former marriage/relationship. In order to petition the court for a stepparent adoption, you must be married and living together as a family. The rights of the non-custodial parent must be terminated before the minor can be adopted. Termination of parental rights can be achieved through various methods, one of those is consent. Consents are signed before a county clerk, a probation officer or, if designated by the county board of supervisors, or an employee of the county welfare department. County government handles these requests exclusively, investigations are handled by the Department of Childrens Services, and all legal issue are handled by the court. A stepparent adoption is when a stepparent petitions the court for adoption of his/her spouse's child (current spouse of stepparent) from a former marriage/relationship. Both the parent retaining custody and the other birth parent must consent to the adoption. Stepparent adoptions are generally much less complicated and are often handled by your local county government.  more
