Even where breaks are disrupted under Regulation 24 of the legislation, staff must be offered “Compensatory Rest”. In essence where a worker is required to work during a period which would otherwise be rest period or rest break, the employer must (wherever possible) allow the worker to take an equivalent period of compensatory rest (reg.24(a)). In exceptional cases, where this is not possible, the employer must afford the worker such protection as appropriate to safeguard the worker’s health and safety (reg.24(b)). Guidance on the working time directive and rest breaks is available from the DirectGov website. As far as practicable the rest should be taken as near in time to when it would ordinarily have been granted. There is not a rigid formula but in general the same periods should be observed.
