Obscene speech is not protected by the First Amendment and cannot be broadcast at any time. To be obscene, material must meet a three-prong test: (1) an average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest; (2) the material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and (3) the material, taken as a whole, must lack serious literary, artistic, political, or scientific value. more

According to the authority on such things, "Webster's Encyclopedic unabridged Dictionary of the English Language" Obscene can be defined as such: "Obscene: 1. Offensive to modesty or decency; indecent; lewd 2. Causing, or intended to cause, sexual excitement or lust 3. Abominable; disgusting; repulsive" So obscene things are pretty much any thing offensive to modesty, or decency. Any thing intended to cause sexual excitement, or lust. And any thing deemed abominable, disgusting, or repulsive. Modesty is something I would like to think I have a lot of, however for the sake of argument I am very smart. I have an IQ ranked in the top 1% of the earth's population and there is no score higher than the one I got on the SAT's, so I am very smart. How ever, according to the FCC my statement of "I am very smart" not being modest, is a flat out obscene statement and not covered by the first amendments freedom of speech.
