What is the difference between contested and uncontested divorce?

0

A divorce case is said to be contested when the parties are unable to agree on key issues. One of the issues that may lead to a divorce case being a contested one is property division.

On the other hand, when parties in a divorce are able to come to an agreement on all important issues before trial, the case is said to be an uncontested divorce.

In a contested divorce, the parties must present their case to a judge, who will then make the final decision. Other issues that may lead to a contest include alimony, child custody, and child support.

When in doubt, you should always consult a divorce lawyer. Chances are you will be needing one anyway because even in an uncontested divorce, the parties must still file the necessary paperwork with the court and attend a short hearing.
