However, to be legally accurate, deportation describes a process which took place under the law in effect before the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA), which came into effect in 1997. After IIRAIRA was passed, “deportation hearings” were re-named “removal proceedings.” The reason for this change is that before IIRAIRA, there used to be two separate types of hearings: (1) Deportation hearings were for people already physically present inside the United States. (2) Exclusion hearings were for people seeking to enter the United States. Now removal hearings include both people already in the U.S., and those seeking to enter. However, inside the removal hearings, people who were lawfully admitted to the U.S. are charged with grounds of deportability which can be found in the Immigration & Nationality Act ยง 237 here whereas people who were never lawfully admitted to the U.S. are charged with grounds of inadmissibilit
