Fraginal is mistaken. The penalty first of all varies by state and can be just a modest fine - some states have statutes regarding vehicular manslaughter or vehicular homicide. Those statutes generally recognize that vehicular manslaughter can be a terrible unintended accident and thus provide for it to be charged as a misdemeanor. Here's a sample from Wikipedia for the state of Georgia. For specific states, you can search by state name + vehicular manslaughter or vehicular homicide or just search vehicular homicide & check for your state in the Wikipedia entry. First degree homicide by vehicle This is a felony, that upon conviction will result in a sentence of between 3 and 15 years of imprisonnment (or between 5 and 20 years for habitual violators), with no parole for at least 1 year.
