What is the meaning of the comments made by Walnut City Attorney Michael Montgomery in the Tribune?

. Walnut City Attorney Montgomery commented to the Tribune that he does not believe Walnut can win a lawsuit against Industry and that we should instead try to settle. This would be a violation of the Brown Act since presumably that was the subject of their closed session on 12/10/2008, and lawsuit strategy is not supposed to be publically discussed.
