It depends on intent, if there was a weapon or object used (brass knuckles or other hard object to hit with) - some assaults are misdemeanors, some are felonious. My husband was just the victim of an assault and I'm researching this too. In my state of Michigan - if a weapon or object was used, it can go beyond aggravated to felonious and then it's prison time, not just jail. For misdemeanor assaults, it can be up to 1 yr in jail + fines and costs. For a felony (with or without intent to do great bodily harm less than murder) it can be up to 5 yrs in prison. I think we can all agree though that the courts generally do not send people to prison or jail for as long as they should though... The victim should seek out a good personal injury attorney and civil sue the offender for personal damages, medical expenses, lost wages, etc... Good Luck!
