What is the responsibility placed upon the property owner who leases space or allows illegal gaming?
Florida Statues, 849.20 and 849.03 specifically relate to renting to gambling houses. Section 849.20 states that a line can be placed on the real property and it can then sold to pay for fines and costs associated with operating a location that maintains slot machines. The owner must either “have knowledge or reason to believe” that their property is being used to operate slot machines. Section 849.03 provides that one who knowingly rents property for the purpose of gaming is guilty of a 3rd degree felony under 849.01. Operation of slot machines, which the Internet cafes function as, would all fall within gaming.
