Referral to the Co-Parenting Mediation Program is mandatory under Utah Code Annotated §30-3-38 when a motion is filed with the Third District Court alleging a dispute over court-ordered parent-time. In addition to this standard, the Third District Court Commissioners have expanded the types of cases and disputes referred to the program to include modifications to the parent-time order, including when one parent moves or anticipates moving out of state.
