Racial vilification, or offensive behaviour based on racial hatred, is unlawful under the Commonwealth Racial Discrimination Act. It refers to any act that is done in public which is reasonably likely to offend, insult, humiliate, or intimidate another person, or group of persons, and the act is done because of the race of that person or group. A complaint under the Racial Discrimination Act must be lodged with the Commonwealth Human Rights and Equal Opportunity Commission.
