What overhead rate should be used when submitting a proposal to an industry sponsor, and a government agency is the prime? Would you use the capped overhead rate or the uncapped overhead rate?

(Applies to GTRC only) If the industry sponsor is giving you a subcontract under a government agency prime contract/award, the overhead rate would be the same as if the funding were coming directly from the federal agency. Use the capped overhead rate for all civilian (non-DoD) federal agencies, regardless of type of award (contract, grant, or cooperative agreement). For DoD, use the uncapped overhead rate for contracts; use the capped rate for grants and cooperative agreements. (The uncapped rate is used only for DoD contracts). The government agencies typically involved in issuing grants are: NSF, NASA, Department of Energy, DHHS, and the Office of Naval Research. If the funds are being awarded through a contract, use the uncapped overhead rate. Typically these are Department of Defense agencies.
