What powers does JACQA have?
A. JACQA is being set up purely as an advisory committee. It does not have any statutory powers. The Committee will make recommendations to the Secretary of State on which 14-19 qualifications should be eligible for public funding. The Secretary of State will then make a decision, informed by JACQA’s advice, under the provisions of Section 96 of the Learning and Skills Act 2000. The co-owners of JACQA, QCA and LSC, both have a legal power to advise the Secretary of State on matters which falls within their area of competence.
