Sorry he has no choice if they re-mortgaged the property then it went into joint names so she is entitled to her share, he does not have the choice of leaving it the his children as it is no longer his. He can sell the house or he can buy her out but he will have to give her her share of the property. He would have been fine if he hadn’t done a joint mortgage but because he did he’s lost I’m afraid. She can also force the sale of the house if she took it to court. I wish I could give you a better answer but that’s just the way it works in the UK I’m afraid.
