The council housing benefit department do do spot checks yearly to make sure they have the right info. Likelihood is that this is what they were doing. You are allowed to have someone staying with you for a few nights – ie, boyfriend/girlfriend. That is not illegal and if it is only a couple of nights a week you do not have to tell anyone. You are entitled to some privacy! Five days a week is complicated. If you have no other address they can try to prove that you are living there – but they have to prove it. If you have an alternative address where mail etc is delivered, then you have a stronger case. Just make sure you do not leave clothes etc lying around and make it clear that she does not do your washing/cook for you etc. My partner stays with me most weekends and occasionally for a week and I haven’t said anything.
