When an alleged violation is contested by the Registered Entity and a settlement cannot be reached, what happens when the hearing result reverses the MRO staff determination of an alleged violation?

The Registered Entity requests a hearing. The MRO will convene the Hearing Body of the MRO which is administered by a qualified, independent hearing officer. In the event the decision of the Hearing Body reverses the MRO staff determination regarding an alleged violation, the alleged violation will be dismissed and the Registered Entity, MRO and NERC will be noticed and the process ends. There would be no appeal from the MRO staff to NERC. However, NERC or the Commission (in the U.S.) could open an inquiry of the dismissed alleged violation.
