All transportation projects requiring an EIS for which the original Notice of Intent was published in the Federal Register after August 10, 2005, must follow the Environmental Review Process. So, if a project , that was originally to be processed as an EA, is elevated and is being processed as an EIS, it must follow the Environmental Review Process.
