In the Superior Court of New Jersey, Law Division, Civil Part, a party seeking any affirmative relief may, at any time after the expiration of 35 days from the service of the pleading claiming such relief (such as a complaint or counterclaim), move for a summary judgment or order on all or any part thereof or as to any defense (such as those presented in an answer or motion). A party against whom a claim for such affirmative relief is asserted (such as a complaint or counterclaim) may move for summary judgment as to all or any part of the claim. In Superior Court of New Jersey, Law Division, Civil Part and unless the court otherwise directs, the motion for summary judgment must be filed 30 days before the trial date and served on the nonmoving parties and filed at least 28 days prior to the motions hearing date.
