Who pays the fees and costs of litigation?
As stated above, The Georgia Constitution and Georgia Statutes provide that the condemning authority must pay the attorney’s fees and experts’ fees incurred by a property owner in an eminent domain matter. Generally, the attorneys who represent property owners, and the expert witnesses agree to seek payment of their fees only from the condemning authority.
