Why did Harvard “pull out”?
• Harvard allowed only its public domain materials to be scanned. To our knowledge, Harvard is completing its public domain digitization. Consequently, the Settlement has little direct impact on them, either positive or negative. • Harvard made its own determination about the relative pros and cons, as will each institution. Their chief concerns appear to center on three main issues: • Other informed observers have taken a more moderate position with respect to these concerns. The Association of Research Libraries, for example, has filed a brief asking the court to monitor several aspects of the Settlement if it is approved but has not recommended scuttling it.
