Hi there. It appears they have made a mistake on your claim. When you are working 16 Hours you are allowed an additional eanrnings disregard of £16.85 per week, and you are allowed to have Child care costs as an expense. When they have ended your Earned income they will not have applied the £16.85 per week disregard, and they will also not have allowed your Childcare expenses as they are no longer treating you as in work. You should be entitled to both these disregards for 39 weeks whilst on maternity. The entitlement to these disregards is covered in Housing benefit regulation 28 (section 14 for maternity pay) . Ring them and tell them they have made a mistake, they should spot their error and correct it fairly quickly. If they do not write to them something along the lines of. I wish to appeal your decision not to treat me as in remunerative work, and there for not allowing for my child care cost to be included in my assesment for housing benefit. Please check Regulation 28 section 1
