It is extremely important to list your ex‑spouse as a creditor so that you can obtain a discharge as to property settlement agreements that you may have failed to honor. The 1994 revisions to the Bankruptcy Code, under 11 U.S.C. 523(a)(15) may make debts subject to hold harmless agreements nondischargeable in a bankruptcy; however, your ex-spouse must except to your discharge by means of an adversary proceeding filed in your bankruptcy case. It is sometimes more safe for you to file a Chapter 13 if this is a problem.
