4.1 NR is not seeking to extend the powers of compulsory acquisition granted by the 2006 Order, but rather it is seeking to overcome previous undertakings not to exercise those powers (NR/4, 7.8.i). The LAO is not accompanied by any applications for new or amended planning, Listed Building or Conservation Area Consents or by an Environmental Statement (“ES”) (NR/3, 4.12). Although the current LAO plan (CD/26) is much more limited in geographical extent than the 2006 Order plan (CD/13), it is otherwise identical (NR/12, page 1).
