How does ERB enforce Environment, Health and safety regulations?
Section 121(1) (c) of the Electric Power Act, mandates ERB to: enforce environmental, [health] and safety regulations in the power sub-sector. The instruments for achieving this as envisaged in the Act are essentially Command and Control types such as Licenses incorporating appropriate environmental standards. Further, Section 9 (3) of the Act requires ERB to take into account the need to protect the environment, conserve natural resources, and protect the health and safety of service users and the public at large, among other things; when appraising applications for licenses. Licenses thus constitute important instruments for enforcing environmental, health and safety standards in Kenya s Electricity Supply Industry (ESI).
