Hello everyone. I currently work for a small travel company, and we are considering offering transfers via an online platform in the Czech Republic. Having started to read about MPO transport rules, I have become somewhat confused. Is it really possible to operate a platform in the Czech Republic without a transport licence? Has anyone encountered this in practice?
Would we be considered a carrier or purely a marketplace? This is important for Czech legislation. I actually encountered a slightly different but related situation. Last year, I wanted to get a job driving for one of the transfer platforms in Prague. Before signing any contracts, I searched online for the rules and came across an article on GetTransfer about MPO Czech transport rules. It analysed the ministry’s position and the EU courts’ decisions in detail. It transpired that certain platforms effectively operate as carriers: they set prices, accept payments and allocate drivers, yet do not possess a Czech licence. After reading this, I thought carefully about it because I didn’t want to run into problems later on. Ultimately, I decided not to get involved with this platform until it brought its activities into compliance with the rules.
