A driver is required by California law (California Vehicle Code section 23612) to submit to a chemical test to determine the alcohol and/or drug content of their blood. If the licensee did not submit to or complete a breath or blood test after being requested to do so by a police or California Highway Patrol officer following a lawful arrest for driving under the influence (DUI).
