What are compensatory damages and what do they cover?
Compensatory damages are designed to compensate the injured person for injury damage and loss suffered as a consequence of the negligence of someone. The law recognizes certain elements of compensatory damages which may be awarded, such as: mental and physical pain, suffering, mental anguish, disability, loss of enjoyment of life, scarring and disfigurement, as well as financial losses such as: unreimbursed medical expenses and medical expenses which will more than likely be incurred in the future, and loss of wages and the ability to earn.
