What is the trickiest part of the Adam Walsh Act?
Deciding if a person is a “sex offender” as defined by the Adam Walsh Act. Laugh as you may, but consider this, which is step 1 in AWA: 42 USC 16911(1), Sec. 111(1) SEX OFFENDER- The term `sex offender’ means an individual who was convicted of a sex offense. This is a two-prong question and each prong must be answered, before a person is considered to be a sex offender. If a person does not qualify as a sex offender, under AWA, then they are exempt from registration. However, individual states -in their version- may get upset at defining “sex offender” and not go along with the AWA way.
