Section 71AA(4) and (5) of the Development Act require that swimming pool safety features are maintained. Regulation 76D(3) lists the swimming pool safety features that must be maintained. Section 71AA(5) requires new pool owners to ensure that the swimming pool safety features that were required at the time an application for consent or approval of the pool was made (regulation 76D(1)(b)) are installed and maintained. For example, the owner of a new pool will need to make sure that: • Gates and child-resistant doors in the child-safety barrier close and latch properly • Fences and walls forming part of the child-safety barrier are maintained in compliance with height, aperture sizes, strength and durability requirements • Any windows required to be child-resistant are maintained in accordance with AS 1926.1 • The child-resistant cover remains on the skimmer box • The swimming pool is not used while a vacuum cleaner is in use • The ‘secondary safety suction point’ is always operational
