Will SJR 14 abolish the Great Writ of Habeas Corpus, dating back the Magna Carta and enshrined in the United States and Utah Constitutions?
• No. The function of the Great Writ was never to re-litigate convictions entered by courts having jurisdiction. It was to aid prisoners held without trial or after having completed their sentences. SJR 14 reforms are limited to post-conviction litigation, which takes place after a conviction has become final and after the direct appeal, if any, is complete.
