It is a federal crime, therefore he gets to go to federal jail. Since the regular federal jails are like a freaking resort, the military likes to make sure proper punishment is received. To clear up one thing…he is no longer in the Army, he’s just in “Army jail.” Eric- He was given a trial by court marshal where all the evidence was presented and ruled on. He would not have been found guilty of desertion without it, unless of course he just admitted it and said he didn’t want a court marshal. There is no mediation in the military, it’s not a democracy. He knew that when he signed up. The military is NOT a “normal” job, and should not be treated as such.
