Are their any legal issues regarding a HLTA teaching food at either KS3 or KS4?
A. Design and Technology environments are high risk areas and learners should be supervised in these environments by qualified specialist staff (Management of H&S at Work Regulations 1999). When non-practical activities are taking place supervising staff should be trained and aware of the risks and control measures that need to be observed. Other design and technology colleagues, e.g. trainee teachers, instructors, technicians, HLTAs and LSAs, should never be in sole charge of learners when practical activities are in progress. It is the employer’s legal responsibility to ensure that each employee is provided with the appropriate training and protection before they use or supervise the use by others of specified D&T equipment. Failure to do so may result in legal proceedings. British Standard BS 4163:2007 has been compiled and endorsed as the national standard by professional and national organisations such as the D&T Association, NAAIDT, TDA, HSE and Local Authorities.
