Professionals who are licensed under Title 8 of the New York State Education Law who are not approved or authorized by OMH, or who are so approved or authorized but do not have employees or volunteers who will have regular and substantial unsupervised or unrestricted physical contact with their clients, are not required to have their criminal histories checked under this law.The law also provides that Article 28 hospitals, as defined in the Public Health Law, are exempt from the OMH criminal history record check process. The exemption covers providers that are included as part of the hospitals Article 28 operating certificate, even if they also hold an Article 31 license issued by OMH.
