Can a debt collection agency garnish my student loans?
No, they can not garnish student loans. Yes they can sue you & garnish wages, bank accounts etc. – They do have to actually obtain a judgment first. I would start making the small payments to them even if they say too low. That will most likely keep them from attempting to sue. When I said they can’t garnish student loans I mean they can’t take from the student loan company, but if it is in your bank then they can.
