Can DAIL determine if an ALC is providing a health service, as defined in KRS 216B.015?

A. Yes. DAIL can make that determination, and will withhold certification until the ALC discontinues the provision of that health service. Further, DAIL is required under law to report to the Office of Inspector General any alleged or actual cases of health services being delivered.
